Welcome to MigraGate. Before using our platform, we invite you to read these Terms of Service carefully. By registering or using our services, you acknowledge that you have read and accepted them in their entirety.
1. Purpose and scope
These Terms of Service (hereinafter "ToS") govern access to and use of the MigraGate platform, accessible at migragate.com (hereinafter "the Platform"), operated by MigraGate SAS (hereinafter "MigraGate"). By accessing or using the Platform, you unconditionally accept these ToS. If you do not accept these terms, please do not use the Platform. These ToS apply to all users, whether individual clients, partners or simple visitors.
2. Description of services
MigraGate is an online platform specialising in international mobility support. Our services include: • Assistance and preparation of visa application files (tourist, work, study, family reunification) • Official invitation requests • Travel insurance subscriptions • Accommodation bookings (hotels, apartments, villas, hostels) • Mobility services (flights, trains, buses, vehicle hire, transfers) • Personalised support from expert advisors MigraGate acts as an intermediary and facilitator. We do not guarantee the granting of a visa or residence permit, the final decision resting exclusively with the competent consular and governmental authorities.
3. Registration and user account
Creating an account is required to access most MigraGate services. Registration conditions: You must be at least 18 years old and have the legal capacity to contract. Minors may use the Platform under the responsibility of their legal representatives. Obligations: You agree to provide accurate, complete and up-to-date information when registering. You are solely responsible for the confidentiality of your login credentials. Security: In the event of loss, theft or unauthorised use of your account, you must notify us immediately at security@migragate.com. MigraGate reserves the right to suspend or delete any account in the event of a breach of these ToS.
4. User obligations
By using the Platform, you agree to: • Provide authentic documents and truthful information in connection with your applications • Not impersonate a third party • Not use the Platform for unlawful, fraudulent or public-order-contrary purposes • Not attempt to circumvent the Platform's security measures • Respect the intellectual property rights of MigraGate and third parties • Not transmit viruses, malware or any harmful code Any breach of these obligations may result in the immediate suspension of your account and, where applicable, legal proceedings.
5. Pricing and payment
The prices of services offered by MigraGate are shown inclusive of all taxes on the Platform and may vary depending on the type of service, destination and processing times. Payment methods: Payments are made by bank transfer, agency deposit or via the methods specified during the order process. Payment is due upon ordering. Timelines: MigraGate undertakes to process your application within the indicated timeframes, subject to receipt of all required documents and full payment. Refunds: In the event of cancellation or visa refusal not attributable to MigraGate, service fees are non-refundable. Specific conditions are set out in our General Terms of Sale.
6. Liability
MigraGate undertakes to deploy all reasonable means to ensure the quality of its services. However: • MigraGate cannot be held liable for the refusal of a visa, permit or residence authorisation by the competent authorities, that decision being within their exclusive sovereignty. • MigraGate accepts no liability for delays or service interruptions beyond its control (force majeure, outages, consular closures, etc.). • MigraGate's liability, in the event of proven fault, is limited to the amounts actually paid by the user for the service concerned. The user is solely responsible for the accuracy and authenticity of the documents and information provided.
7. Intellectual property
All elements of the Platform (texts, images, logos, design, source code, databases) are protected by intellectual property law and belong to MigraGate or its partners. Any reproduction, representation, modification, publication or adaptation, in whole or in part, of these elements, by any means or process, is prohibited without prior written authorisation from MigraGate.
8. Personal data protection
MigraGate processes your personal data in accordance with its Privacy Policy, accessible on the Platform, and in compliance with the General Data Protection Regulation (GDPR). Your data is collected for the purposes of the service ordered, account management, and improvement of our services. It is never sold to third parties. 9. Amendments to the ToS
MigraGate reserves the right to amend these ToS at any time. Amendments take effect upon publication on the Platform. In the event of a substantial amendment, MigraGate undertakes to inform users by email or Platform notification at least 30 days before the new conditions take effect. Continued use of the Platform after amendment constitutes acceptance of the new ToS.
10. Governing law and jurisdiction
These ToS are governed by French law. In the event of a dispute, and failing amicable resolution, the competent courts of Paris shall have sole jurisdiction. For consumer disputes, the user may also have recourse to an approved mediator in accordance with Articles L.611-1 et seq. of the French Consumer Code.
